Despite your initial reaction, sadness, anger or fear, try the following:
- In a divorce, you may want to make emotionally charged decisions. Resist. You don’t want to say or do anything that may come out later in court.
- For safety sake, if you need to remove yourself or your children from the home contact a lawyer immediately. Otherwise do not voluntarily leave the family residence.
- Do not post any disparaging statements or pictures on any social media about your spouse. More and more Facebook and other types of social media are being used in court. Pictures of yourself out partying, dating, or making large purchases may be used in court. Post nothing on social media.
- Get organized. Copies of all financial statements, banking records, income tax returns, photographs, etc. will be needed in court.
- Remain polite and courteous to your spouse if you need to live together until all matters are settled. Walk away from conflict. Let your attorney handle disputes. Remind your spouse that you have an attorney to deal with the disagreements.
- Information is power; don't tell your spouse more than you need to.
- Do not make agreements or sign anything without your lawyer being involved.
- Don't rub in your legal victories. Payback can come around. When you win, walk away in silence and humility. You can relax and feel vindicated later.
